LEGAL INTEREST RATE UP TO 2,5%

Starting from 1st January 2012 the legal interest rate according to article 1284 of Italian civil code has been increased to 2,5%.

THE ITALIAN ENVIRONMENT IS PROTECTED BY NEW CRIMINAL OFFENCES

A new decree entered into force today enacted the 2008/99/EC e 2009/123/EC directives and amended many law provisions: among other things, the decree introduced the following criminal offences in Italian Criminal Code:
- article 727-bis - Slaying, destruction, capture or detention of wild animals or vegetables which are protected by the law
- article 733-bis - Destruction or deterioration of an habitat within a protected location.
The violation of the new law by an individual may lead to direct liability of firms and companies pursuant to Italian Decree 231/2001.

CONDOMINIUM – HOW TO OBJECT DELIBERATIONS UNDER ITALIAN LAW

The Joint Sitting of the Court of Cassation resolved a disagreement amid the Second Division of the court and stated that oppositions against a condominium’s deliberation must be filed through a writ of summons according to article 163 of Italian Civil Procedure Code.

EU NEW PROVISIONS AGAINST LATE PAYMENTS IN COMMERCIAL TRANSACTIONS

The European Parliament approved a new directive that will repeal the directive n. 2000/35/EC (implemented in Italy with decree n. 231/2002).
Amongst other important provisions, the general period for payment shall not exceed 60 days for transactions between undertakings, and 30 days for transactions between undertakings and public authorities.
The national regulations necessary to comply with the directive shall come into force not later than 16 March 2013 (and the States may decide whether to apply the new rules to agreements concluded before that date).
